What is Mediation?
Mediation is a type of dispute resolution and is a formal process where dialogue and negotiation replace arguments and power struggles. An impartial mediator assists the participants to jointly explore and reconcile their differences in a structured way. What is said within the mediation remains confidential and there is a written outcome.
Reactive Mediation has been used extensively to resolve workplace conflict brought about by:
- Allegations of harassment
- Poor management practices
- Acts of undisputed harm such as theft
- Significant gender imbalances in the workforce

Facilitated Discussions (a less formal process)
The use of a neutral facilitator can work wonders in uncovering great ideas or finding perfect solutions even when there is no conflict. Facilitated Discussions occur where the facilitator assists parties in dispute to reach agreement and what is discussed in the process may be shared with others. We have over 20 years of experience in facilitating outcomes for both State and Local Government agencies as well as in the private sector. We facilitate matters as diverse as discussions about town planning issues to business disputes.
Family Law Mediation
The Family Court of Australia encourages mediation because it is an affordable and often quick option for resolving disputes, while allowing you greater control and management of the process and the outcome.
Fees
- If the mediation exceeds the fixed time, then each additional hour shall be charged at $440 (incl. GST)
- There is no fee for the use of the rooms
- Up to two hours reading of material and preparation by the mediator
- 20-minute session with each legal representative and client at the commencement of each mediation

A Four Stage Process
Ross offers a unique four stage process which addresses disputes whether the eventual process is a mediation, workplace conference or other form of dispute resolution:
- Assessment: Preliminary assessment to scope and analyse the situation
- Appraisal: An expert opinion on the most effective process for your needs
- Delivery: Mediation or workplace conference or expert advice.
- Reporting: Upon request and, if appropriate, Ross can provide a comprehensive report which assists in ongoing management

Workplace Assessment
The purpose of this process is to identify practical interventions that organisations can take to identify problems and make recommendations for next steps including mediation or investigations. Staff are interviewed to provide their perspectives and what they think should be done. A written report that refers to the National Mediations Standards provides details of themes affecting the morale of staff and recommendations as to what ‘reasonable management action’ should be undertaken.
